Applies to: MergersCorp.com (“we,” “our,” or “us”) Services that may be used for the transmission of bulk or commercial electronic mail (“Covered Services”).

1. Zero Tolerance Policy

MergersCorp.com maintains a Zero Tolerance policy against the transmission of unsolicited commercial email (UCE), commonly known as “spam,” through our Covered Services. Compliance with this Anti-Spam Policy is a mandatory precondition for the use of all Covered Services. We reserve the absolute right to immediately suspend or terminate any User account that violates this policy, with or without prior notice.

2. Definition of “Permission”

Covered Services may be used only for sending emails or messages to individuals from whom you have obtained explicit, verifiable, and express permission to receive communications on the subject matter of the mail or message (i.e., permission-based marketing).

Express permission may be demonstrated by, but is not limited to, the following examples:

  • Direct Subscription: The recipient actively subscribed to an email newsletter or mailing list by completing a form on your website.

  • Opt-In Checkbox: The recipient completed a form and actively checked an opt-in box, provided the box was unchecked by default and the recipient was clearly informed that the nature of the emails would be commercial or promotional.

  • Transactional Inclusion: The recipient submitted their email address as part of downloading content, ordering a product, or purchasing a service from you, and was informed that marketing emails would follow.

  • In-Person Consent: The recipient provided a business card and expressed willingness to receive commercial emails. Willingness will be presumed if the business card was willingly dropped into your designated collection point (e.g., a tradeshow booth).

  • Event Participation: The recipient provided their email address as part of participating in a contest, event, or survey, and was explicitly informed that they would receive marketing emails.

3. Strict Compliance Rules (The Rule of Thumb)

The overarching principle is: Do not use Covered Services to send mail or messages to email addresses for which you do not possess demonstrable, express permission to send emails on that specific subject.

You shall comply strictly with the following technical and operational rules:

3.1. Proof of Consent You must maintain and be able to provide sufficient, verifiable proof of permission for every recipient on your mailing list, including the date and method of consent acquisition, upon our request.
3.2. Prohibited Lists You shall not import or send emails to addresses that have been bought, loaned, rented, licensed, or otherwise acquired from a third party. This includes addresses collected from other websites.
3.3. Accurate Headers You must ensure that the routing, header information, “From” and “To” fields, originating domain name, and email address are true, accurate, and not misleading.
3.4. Non-Deceptive Subject Lines You shall not use subject lines that mislead the recipient about the contents or subject matter of the message.
3.5. Unsubscribe Mechanism All commercial emails must include a conspicuous, one-click unsubscribe option that is easy for the recipient to use.
3.6. Timely Opt-Out Honor Requests to opt-out or unsubscribe from the mailing list must be honored and implemented within ten (10) days from the date of the request.
3.7. Physical Address All emails sent through Covered Services must clearly include your valid physical postal address.
3.8. Conspicuous Notice All marketing emails must include a conspicuous notice that the message is an advertisement or solicitation and inform the recipient of their right to opt out of receiving future commercial emails.

4. Auditing and Enforcement

We reserve the right to require you, at any time, to prove that you possess express permission to send emails to all email addresses you have imported or used with our Covered Services.

While we insist on 100% compliance, we understand that occasional complaints (where a recipient marks an email as spam despite having granted valid permission) may occur. However, if a recipient opts out or unsubscribes, the prior permission is automatically deemed to have been revoked.

Your use of the Covered Services constitutes your unconditional acceptance of and agreement to abide by this Anti-Spam Policy.
